1. TERMS OF SERVICE
Banana VPN Terms of Service
Effective Date: September 11, 2026
These Terms of Service ("Terms") govern your access to and use of Banana VPN, including the Banana VPN applications for iPhone, iPad, Mac, Android, Windows, television devices, websites, VPN servers, customer portals, subscription services, and related services collectively referred to as the "Service."
By creating an account, purchasing a subscription, downloading or using Banana VPN, or otherwise accessing the Service, you agree to these Terms.
If you do not agree to these Terms, do not use Banana VPN.
1. The Service
Banana VPN provides virtual private network ("VPN") functionality designed to encrypt network traffic between your device and a Banana VPN server and to provide additional privacy and security when accessing the internet.
Banana VPN may provide different server locations, applications, connection protocols, subscription plans, device allowances, and other features depending on your plan, device, operating system, geographic region, and service availability.
A VPN improves the privacy and security of a network connection but does not make a user completely anonymous and does not guarantee protection from every security threat.
2. Eligibility
You must have the legal capacity to enter into this agreement.
If you are under the age of legal majority in your jurisdiction, you may use the Service only with authorization from a parent or legal guardian who accepts these Terms on your behalf.
You may not use the Service if your use is prohibited by applicable law.
3. Account Registration
Certain features require a Banana VPN account.
You agree to provide accurate information and keep your account information reasonably current.
Account information may include your name, email address, account identifier, subscription information, and device or installation identifiers required to provide the Service.
You are responsible for safeguarding your account credentials and for activity conducted through your account.
You must notify Banana VPN promptly if you believe your account has been accessed without authorization.
You may not sell, transfer, rent, or commercially share your Banana VPN account unless Banana VPN expressly authorizes such activity.
4. VPN Credentials and Devices
VPN credentials, configuration files, access tokens, server information, certificates, and related credentials provided through the Service are intended solely for authorized use with your Banana VPN account.
You must not publicly distribute credentials or intentionally allow unauthorized users to use your subscription.
Device limits may apply according to your subscription plan.
Banana VPN may restrict or terminate sessions that exceed applicable device or connection limits.
5. Subscriptions
Some Banana VPN functionality requires a paid subscription.
Available plans, pricing, subscription periods, features, and device limits are displayed before purchase.
Plans may include monthly or annual subscriptions.
Subscription availability and pricing may vary by country, platform, currency, taxes, and distribution channel.
6. Apple In-App Purchases
Subscriptions purchased through the Apple App Store are processed by Apple using Apple In-App Purchase.
Apple, not Banana VPN, processes the customer's Apple payment method.
Banana VPN may receive subscription and transaction information required to verify the purchase and activate the appropriate Banana VPN entitlement, but Banana VPN does not receive the full payment card or bank account information used for the Apple purchase.
Apple subscriptions automatically renew unless canceled according to Apple's subscription rules.
Users may manage or cancel Apple subscriptions through their Apple Account subscription settings.
Refund requests for purchases made through Apple must generally be submitted through Apple's applicable refund process.
7. Purchases Through Other Platforms
Subscriptions purchased directly from Banana VPN or through another authorized platform are governed by the billing and cancellation terms displayed when the purchase is made.
Payment processors may process payment information on behalf of Banana VPN.
Banana VPN does not require users to provide payment-card information to the Apple version of the app when the transaction is completed through Apple In-App Purchase.
8. Automatic Renewal
Where a subscription is described as automatically renewing, it continues for successive subscription periods until canceled.
Cancellation stops future renewal. Unless otherwise required by applicable law or the applicable store's rules, cancellation does not immediately terminate access already paid for. Service normally continues until the end of the current paid subscription period.
Deleting the Banana VPN application does not automatically cancel a subscription.
Deleting a Banana VPN account also may not automatically cancel a subscription billed through Apple or another third-party marketplace. You must separately cancel the subscription with the applicable billing provider.
9. Taxes
Prices may be subject to applicable sales taxes, value-added taxes, goods and services taxes, or other government charges.
Where Apple or another marketplace processes a transaction, the marketplace may calculate and collect applicable taxes.
10. Acceptable Use
You must use Banana VPN lawfully.
Your use of Banana VPN is also subject to the Banana VPN Acceptable Use Policy, which forms part of these Terms.
You may not use Banana VPN to conduct unlawful activity, attack networks or systems, distribute malware, send spam, commit fraud, violate intellectual-property rights, harm others, interfere with the Service, or circumvent restrictions imposed by law.
11. No Permission to Break the Law
Banana VPN is a privacy and security service.
Use of a VPN does not exempt you from the laws applicable to you.
You are solely responsible for determining whether and how VPN services may legally be used in your jurisdiction.
Banana VPN does not encourage copyright infringement, unauthorized access, fraud, harassment, malicious activity, or violation of third-party rights.
12. Service Availability
We work to maintain reliable access to the Service, but VPN connectivity depends on factors outside our control, including internet providers, operating systems, device configurations, government restrictions, third-party networks, data centers, and local network conditions.
We do not guarantee that every server or geographic location will always be available.
Servers may be added, removed, temporarily unavailable, or changed for maintenance, security, capacity, legal, or operational reasons.
13. Speed and Performance
VPN use may affect latency, connection speed, bandwidth, or access to certain websites and services.
Actual performance depends on factors including your physical location, ISP, selected VPN server, server load, device, network quality, and VPN protocol.
No specific speed or uninterrupted connection is guaranteed.
14. Third-Party Websites and Services
Banana VPN may allow you to access websites, applications, or services operated by third parties.
Banana VPN does not control those third-party services and is not responsible for their content, availability, privacy practices, terms, or security.
Your relationship with a third party is governed by that third party's applicable terms.
15. Intellectual Property
Banana VPN and its related software, branding, interface, graphics, designs, documentation, websites, trademarks, and proprietary technology are owned by or licensed to Banana VPN and are protected by applicable intellectual-property laws.
Except as expressly permitted, you may not copy, reproduce, modify, distribute, sell, sublicense, reverse engineer, circumvent protections in, or create derivative works from proprietary portions of the Service.
Nothing in these Terms limits rights provided by applicable open-source software licenses.
16. Updates
Banana VPN may provide software updates to improve functionality, security, compatibility, or performance.
Some updates may be required for continued access to the Service.
Features may change as platforms, operating systems, security requirements, and VPN technologies evolve.
17. Security
You must not attempt to bypass security mechanisms, probe Banana VPN infrastructure without authorization, interfere with service operation, obtain another user's credentials, or gain unauthorized access to systems or data.
We may take reasonable steps to detect and prevent fraud, abuse, unauthorized access, and security threats.
18. Privacy
Our collection and use of personal information are described in the Banana VPN Privacy Policy.
We do not use account information for cross-app or cross-site advertising tracking as described in that policy.
19. Suspension and Termination
Banana VPN may suspend or terminate access where reasonably necessary because of:
violation of these Terms or the Acceptable Use Policy;
fraud or attempted fraud;
unauthorized account sharing;
abuse of network resources;
attacks on systems or users;
non-payment;
legal requirements;
security concerns; or
conduct that creates material risk to Banana VPN, its infrastructure, other users, or third parties.
Where appropriate and reasonably possible, we may provide notice or an opportunity to correct a violation.
Serious, illegal, fraudulent, or security-threatening activity may result in immediate suspension.
20. Account Deletion
Users may request deletion of their Banana VPN account through available account-management functionality or customer support.
Account deletion may result in loss of stored account information, settings, and access to the Service.
Certain information may be retained where reasonably necessary for legal compliance, fraud prevention, security, dispute resolution, financial recordkeeping, or enforcement of these Terms.
Deleting an account does not necessarily cancel a subscription purchased through Apple or another third-party billing provider.
21. Disclaimer of Warranties
To the maximum extent permitted by law, Banana VPN is provided on an "as is" and "as available" basis.
We do not guarantee uninterrupted access, error-free operation, access to every website or service, a specific connection speed, or complete anonymity.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
22. Limitation of Liability
To the maximum extent permitted by applicable law, Banana VPN and its operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of or inability to use the Service.
Nothing in these Terms limits liability where such limitation is prohibited by law.
Mandatory consumer-protection rights remain unaffected.
23. Changes to the Service
We may modify, improve, replace, suspend, or discontinue portions of the Service when reasonably necessary.
Material changes affecting paid subscriptions will be handled in accordance with applicable law and applicable marketplace requirements.
24. Changes to These Terms
We may update these Terms to reflect changes in the Service, law, security requirements, or business practices.
The updated effective date will be displayed at the top of this page.
Where required, we will provide additional notice of material changes.
25. Governing Law
These Terms are governed by the laws applicable to Banana VPN's service provider, subject to mandatory consumer-protection laws that may apply in your country or place of residence.
Nothing in these Terms deprives a consumer of rights that cannot legally be waived.
