End User License Agreement (EULA)
Effective date: 2026-09-12 · Version: 1.0
The license terms that govern use of the applications and software provided by this business.
Banana VPN End User License Agreement
Effective Date: September 11, 2026
This End User License Agreement ("EULA") governs your use of the Banana VPN software applications and related software components.
By installing, accessing, or using Banana VPN, you agree to this EULA.
1. License
Subject to your compliance with this EULA and the Banana VPN Terms of Service, Banana VPN grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use Banana VPN on devices you own or control, subject to applicable platform rules and your subscription plan.
Banana VPN is licensed, not sold.
2. Apple App Store Users
For Banana VPN downloaded through Apple's App Store, this EULA is between you and the Banana VPN application provider, not Apple.
Apple is not responsible for providing the Banana VPN VPN service, technical support, or maintenance except to the extent Apple separately agrees under its own terms.
Your use of the application must comply with Apple's applicable App Store Usage Rules.
Nothing in this EULA is intended to reduce rights provided to you under applicable Apple terms or mandatory law.
Apple's current Standard EULA similarly treats App Store applications as licensed rather than sold.
3. Permitted Use
You may use Banana VPN for lawful personal or authorized organizational purposes, including protecting network connections, securing traffic on public networks, and accessing VPN servers available under your subscription.
4. Restrictions
Unless applicable law expressly permits otherwise, you may not:
copy Banana VPN except for permitted backup or installation purposes;
sell, rent, lease, sublicense, or redistribute the software;
reverse engineer, decompile, or attempt to derive proprietary source code;
modify or create unauthorized derivative works;
circumvent subscription, authentication, licensing, or security controls;
extract or redistribute VPN credentials;
use the software to attack Banana VPN or third-party systems; or
use the software in violation of the Acceptable Use Policy.
Restrictions do not override rights granted by applicable open-source licenses.
5. Open-Source Components
Banana VPN may include or interact with open-source software.
Open-source components are governed by their applicable licenses.
Where an open-source license provides rights inconsistent with restrictions in this EULA, the applicable open-source license governs that component.
6. VPN Network Extension
On supported Apple platforms, Banana VPN may use Apple's Network Extension technology and a Packet Tunnel Provider to establish VPN connections.
The operating system may ask you to approve creation of a VPN configuration.
Certain functionality will not work if required system permission is denied.
7. Ownership
Banana VPN and its licensors retain all ownership rights in proprietary software, designs, trademarks, technology, documentation, and other intellectual property not expressly licensed under this EULA.
No ownership rights are transferred to you.
8. Updates
Banana VPN may issue updates for security, reliability, compatibility, performance, legal compliance, or new functionality.
Some updates may be necessary to continue using the Service.
This EULA applies to updates unless an update is accompanied by different terms.
9. Subscriptions and Paid Features
A valid subscription may be required to access VPN servers or premium functionality.
Purchases made through Apple are subject to Apple's payment, subscription, cancellation, and refund mechanisms.
The software may verify subscription entitlement with Banana VPN servers and applicable application stores.
10. Privacy
Use of the application is subject to the Banana VPN Privacy Policy.
Banana VPN may process account, device, purchase, operational, and support information as described there.
Banana VPN does not use such information for cross-app advertising tracking under the stated policy.
11. External Services
Banana VPN relies on internet connectivity and may interact with data centers, cloud infrastructure, Apple services, payment systems, email services, and other third-party infrastructure.
Availability of third-party systems is outside Banana VPN's complete control.
12. Maintenance and Support
Banana VPN is responsible for support and maintenance obligations applicable to the Banana VPN software, except where a platform provider separately assumes responsibility.
Support is available through the Banana VPN support channels.
13. No Warranty
To the maximum extent permitted by law, the software and Service are provided "as is" and "as available."
Banana VPN does not warrant that the application will always operate without interruption, that every VPN server will always be available, that every website will remain accessible, or that VPN use provides complete anonymity.
Mandatory warranties and statutory consumer rights that cannot legally be excluded remain unaffected.
14. Product Claims
Banana VPN, rather than Apple or another application marketplace, is responsible for claims relating to the Banana VPN application to the extent required by applicable law.
This includes claims concerning the application's operation, legal compliance, and consumer-protection obligations for which Banana VPN is legally responsible.
15. Intellectual-Property Claims
If a third party claims that Banana VPN infringes intellectual-property rights, responsibility for investigating and resolving such a claim rests with Banana VPN as required by applicable law, not with Apple merely because Apple distributed the application.
16. Legal Compliance
You represent that you will use Banana VPN in accordance with applicable law.
You may not use or export the application where prohibited by applicable sanctions, export-control laws, or other binding restrictions.
17. Termination
This license remains effective until terminated.
Your rights under this EULA may terminate if you materially violate this EULA, the Terms of Service, or the Acceptable Use Policy.
Upon termination, you must stop using the software where required.
Termination does not eliminate payment obligations already incurred.
18. Limitation of Liability
To the maximum extent permitted by law, Banana VPN is not liable for indirect, special, incidental, consequential, or punitive damages arising from the software or Service.
Nothing in this EULA limits liability that cannot legally be excluded.
19. Third-Party Beneficiary for Apple Users
For applications obtained through the Apple App Store, Apple and Apple's subsidiaries are intended third-party beneficiaries of the Apple-specific provisions of this EULA and may enforce those provisions where applicable.
20. Relationship to Other Policies
This EULA should be read together with:
Banana VPN Terms of Service;
Banana VPN Privacy Policy;
Banana VPN Refund and Cancellation Policy; and
Banana VPN Acceptable Use Policy.
If mandatory marketplace rules or consumer laws conflict with this EULA, those mandatory requirements control to the extent of the conflict.
21. Contact
Questions about this EULA may be submitted through the Banana VPN support system or the contact options available on vpn-banana.com.
